Litigation Victories in a Post-Roe Legal Landscape

The Lawyering Project recently secured litigation victories in Alabama and Indiana that stem the tide of post-Roe anti-abortion restrictions in the United States.
In late March, a federal district court in Alabama issued a ruling that prevents the Alabama Attorney General from making good on his threats to prosecute people who help pregnant Alabama residents travel out of state to obtain lawful abortion care. Also in March, an Indiana state court issued a preliminary injunction barring the Indiana Department of Health from releasing documents containing sensitive information about abortion patients’ demographics, medical history, and medical treatment to members of the public.
These victories have a concrete impact on people seeking, providing, and supporting abortion. Abortion funds – including the Yellowhammer Fund, which served as a plaintiff in the Alabama case – have resumed funding Alabama residents seeking lawful out-of-state abortions, and the health records of abortion patients remain confidential in Indiana for now.
